thanks Brendan,

that makes perfect sense even if I think there's a bit of a blag going on there.

they were both the result of driving while tired and without being in the mind of the individuals not how you could prove one way or the other.

to my mind the nurse should have gone down and for longer - she tried lying.

Mr Land Rover didn't kill anyone but unfortunately as a consequence of his vehicle being on the track it did lead to disaster.

I get it that I don't know all the details but on the face of it they should have at least got the same punishment?

You only need to read the articles to understand they are different circumstances and offenses. 1993 200 Tdi 90 CSW

The driver of the Selby Land Rover still does not accept the responsibility of the 10 deaths saying that no deaths occurred at the point of impact with his Land Rover. The actual deaths occurred about 700 metres from the Land Rover as the first train become partially derailed fro the impact with the Land Rover . It then travelled about 700 metres further before colliding with the coal train. The driver pleaded not guilty at the court.

Total insurance claim is in the region of £50 million

In the second case the nurse pleaded guilty of causing a single death by careless driving.

The two cases are completely different.
