Yup, it's the type of sleep you have when you're very, very, very small. Monsieur Le Grenadier

Isn't it just a case of one rule for one very particular set of tragic circumstances and another rule for a different set of tragic circumstances? Each had different causes and consequences. What needs explaining? Darren

Yep, pretty much as I see it. Not sure what point the OP is trying to make?

?
didn't they both fall asleep and as a result they both ended up killing someone(s).

if anything the land rover guy didn't even kill anyone directly - had the train stopped it would have been fine?

on the other hand the nurse directly killed someone ?

makes no sense to me but clearly others have a different opinion ?

Both guilty parties were "up all night", be it on the phone to a woman or partying....

Both crashed just before 0500h and caused multiple deaths.

Yes, I agree, they should have both got the same sentece.

The one was a short trip where someone miss-judged their own tiredness. The other knew they were very tired and tried to fight sleep deprivation at motorway speeds. Also the scale of the two offensives is massively different.

I don't think they're very comparable.

One thing I didn't like from the nurse case:

Quote:
Thomas was interviewed and at first claimed she had swerved to avoid something which had run out in front of her.

But an analysis of her car and the accident scene found no evidence or swerving or braking.

/\ isn't that a bit like saying yes I was drunk but it was only a short journey, granted I killed a bus full of people but it was only a short journey?

to my mind the nurse should have gone down and for longer - she tried lying.

Mr Land Rover didn't kill anyone but unfortunately as a consequence of his vehicle being on the track it did lead to disaster.

I get it that I don't know all the details but on the face of it they should have at least got the same punishment?

Selby train crash accused was found guilty of causing 10 deaths by dangerous driving.

Birmingham crash accused was found guilty of causing a single death by careless driving.

Quote:

The maximum prison sentence the court can impose for causing death by dangerous driving or careless
driving under the influence of drink or drugs is 14 years; for causing death by careless or inconsiderate driving it
is five years; and for causing death by driving whilst unlicensed, disqualified or uninsured it is two years. The
maximum sentence is reserved for rare cases where blame is exceptionally high.

Above taken from sentencingcouncil.org.uk here

Both were accused of different crimes which have different potential maximum punishments.
