Don’t get me wrong. They offered already a new engine but that’s not how it works here in AUS. They further admitted that the engine needs to be replaced. This constitutes a major failure in Oz which gives consumer absolute sole discretion to choose from 3 options. In my case a) new engine b) new car or c) all moneys back. And all moneys means ALL: deposit, lease payments, legal costs, export witness costs, insurance, registration costs etc ALL. It also means they need to pay out lease as the finance arrangement was done by the dealer it is regarded a linked credit contract. So we are already talking about large amounts of money. In this thread I earlier provided a link to a landmark case JLR lost which is still regarded as a precedent. She bought a Vogue for around 235k. JLR thought giving her the runaround would be smart and they lost paying more than 670k, so almost 3x. Good business acumen from them and great corporate governance. Defender 90 V8 MY23

Update 1 May 2025
"Miraculously", on the eve of the first court hearing, a substantially improved offer was sent by JLR lawyers. While it was improved significantly, it was insufficient to consider and was rejected before the hearing.

The next day hearing and about 2h ping-pong took place. Having reached my limits, I made a final offer, and if not accepted, I would walk away and take my chances for a full 3-member court session.

And voila, light came into the tunnel, and it was accepted.

Back to the tribunal, which documents the agreement reached and issues respective orders. Parties will sign a deed by next Wednesday, and payment to be made within 7 days, so by 22/05.

After the hearing, I drove straight to the closest dealership of a Zuffenhausen manufacturer to order a new car. Very Happy Big Cry
