When JLR won't give you a new engine - this is what to do. It certainly worked for this guy.

(Good luck with your litigation, hope you get your new engine and they get hefty legal costs) Defender 90XS SW

@Discomog,

Don’t get me wrong. They offered already a new engine but that’s not how it works here in AUS. They further admitted that the engine needs to be replaced. This constitutes a major failure in Oz which gives consumer absolute sole discretion to choose from 3 options. In my case a) new engine b) new car or c) all moneys back. And all moneys means ALL: deposit, lease payments, legal costs, export witness costs, insurance, registration costs etc ALL. It also means they need to pay out lease as the finance arrangement was done by the dealer it is regarded a linked credit contract. So we are already talking about large amounts of money. In this thread I earlier provided a link to a landmark case JLR lost which is still regarded as a precedent. She bought a Vogue for around 235k. JLR thought giving her the runaround would be smart and they lost paying more than 670k, so almost 3x. Good business acumen from them and great corporate governance. Defender 90 V8 MY23

Update 1 May 2025
"Miraculously", on the eve of the first court hearing, a substantially improved offer was sent by JLR lawyers. While it was improved significantly, it was insufficient to consider and was rejected before the hearing.

The next day hearing and about 2h ping-pong took place. Having reached my limits, I made a final offer, and if not accepted, I would walk away and take my chances for a full 3-member court session.

And voila, light came into the tunnel, and it was accepted.

Back to the tribunal, which documents the agreement reached and issues respective orders. Parties will sign a deed by next Wednesday, and payment to be made within 7 days, so by 22/05.

After the hearing, I drove straight to the closest dealership of a Zuffenhausen manufacturer to order a new car. Very Happy Big Cry

I will post one final update when all is done. Defender 90 V8 MY23

Final Update
My final update:

* The deed was signed, however our friends from JLR were 1 day late in getting all signatures Rolling with laughter
* As a result of that, they unilaterally assumed, that they could make payment also 1 day later Embarassed
* Needless to say, that's not how tribunal orders work, if one party delays due to administrative incompetence
* I obviously wasn't happy, and we agreed that JLR would cover the add. payout amount from the financier, as the finance settlement was after the previous payout validity period
* Believe it or not, and even though I provided an updated payout letter to them and they confirmed by reply email that they had received it.....next day payment was wrong Big Cry Big Cry Big Cry
* Still waiting for approx. $65 (which I will convert into well-deserved pints of local brew) but have taken delivery of a new Cayenne GTS MY25 yesterday.

To end this thread on a high note: When I went to the JLR dealer to hand over notice of disposal, key etc. the service manager there - a really really nice guy said, "....Hey, come with me here around the corner...." and there it was: brand new first edition Defender Octa, Faroe Green, Golden recovery hooks, widened wheel arches, carbon in the bonnet and NOT sold ........ I almost, almost called 1-800-Cancel-The-Porsche but I recalled George Bush: "Fool me once...."

On that note, all the best to everyone and lets see if I will be back on this page at some stage! Defender 90 V8 MY23
