Graffty99 you are not on your own,
These are pictures of a chassis on a 1984 90 that passed its MOT a few years ago. A few months later I booked this 90 in for an exhaust replacement at Land Ranger and they informed me that if I were to tow a heavy fully loaded trailer the back of the chassis would snap off. Ended up having a chassis swap.

my 300 tdi failed badly on that, and it cost me 500 quid to fix it! 100 quid was for the two mots, and 300 for it to be welded, and another 100 for the mot tester to redo the job properly.
Laugh was it went through the previous mot, with the side rotten, but the other side was welded up. On the Mot failure history both sides had been picked up, and one side had only been patched. This was what steered me to think it had a questionable MOT, When I started to dig further into the car with my dad. A Knackered damper, seized brakes, dodgy steering which me and my dad had to correct, ( 1st job we did just to make it safe!) It was ok at low speed, but when you took her 40 mph, things got very hairy! Luckly enough this one is ok but needs a few patches on the rear. My dads is ok for now oddly enough, but he has had a new rear crossmember on his at some point. Defender TD5 90 ---/--- Peugeot 306 HDI hatch back

It’s always worse than it looks, this was mine when I changed the chassis. It technically had a few months MOT left.

There was no distortion to the bodywork though and it did plenty of towing in the last few years preceding that. The ladder frame is massively strong, not like modern vehicles which get their strength from clever pressings and joints of much thinner metal. I repaired similar rot to that in gillarion’s photos on mine years back, you can see above where I boxed in the top of the A-frame crossmember. I had to take the body off to do it, so a new chassis makes some sense but I was a poor student at the time! Definitely wouldn’t say it would break in half with a trailer on though.

Grafty to me that is a definite fail, it’s a structural component well within 30cm of the mount.

You have two choices go back to the dealer and report it, they have to then question the inspector and review his competency and deal with the problem.

If they are being funny you can report them for unsafe practice and sub standard work (I believe it is VOSA) will then send a pre inspected car to assess them. Now each inspector is different and they have a small amount of leeway as it’s their discretion but this is an obvious fail from what I can see and isn’t safe to be driven. 90 wolf - Jasmin http://www.defender2.net/forum/topic39408.html

Well, possibly the most disappointing outcome you could imagine.

Basically the service manager was super defensive, told us that they were doing us a favour by passing it and that the other damage they caused under the vehicle (ripping the heat shield out of the way to access the prop shaft) was absolutely nothing to do with them (despite the fact that they are the only people who have done any work on the vehicle).

He said that they would check the wording of the MOT book to see if they need to fail it Shocked

Basically, the poorest customer service and attitude that it's possible to get. And to top it off, my parents have bought 5 or so vehicles from this dealership Rolling Eyes 2002 90 Td5 Station Wagon

Words escape me.

They are doing 'favours' by passing vehicles which should not be passing their MOTs? Shocked

That is not something I would have admitted to, but it's nice to know they were on your side Whistle

Yes it was a pretty disappointing outcome. Hopefully a conversation with the Landrover "customer experience centre" will go slightly better Confused 2002 90 Td5 Station Wagon

That’s sounds like they have admitted the vehicle was not road worthy at the time of inspection and passed to save them work, that should be reported and the test should loose his MOT testing accreditation. I did have a colleague who passed a vehicle as roadworthy once, when it arrived at my location I checked it over and found it to be anything but, he was quickly dismissed from conducting vehicle inspections.

I think the biggest problem here (not saying your vehicle isn’t) but how many other vehicles in what states have they passed as it’s done the customer a “favour”. This needs reporting and them being audited with the possibility of loosing their ability to conduct inspections. 90 wolf - Jasmin http://www.defender2.net/forum/topic39408.html

Report them for passing a vehicle that should fail.

Dealers just take the Censored grafty, just shows you they dont want the hassle of sorting it out with it been under warranty. They are very quick in taking the money off you and telling you to do one, when stuff like this props up.
I wouldnt do buisness with them anymore, and i would DVSA in volved and see what they say and tell landrover customer experince that you are getting them involved too. That will stir the pot for them, if they are passing something thats failed. Defender TD5 90 ---/--- Peugeot 306 HDI hatch back
