Puma Defender as a business vehicle.
l've been offered a good deal on a 2015 Defender 110 XS Station Wagon.

As DVLA see these as Commercial Vehicles has anyone put one through a LTD Company as a working vehicle and claimed the tax back?

HMRC say they are "cars" but l wonder if you could prove that it was completely business use HMRC would look favourably on it.

lf l bought the 2015 110 the first thing l would do is remove the two lock and fold rear seats. l would be happy to blackout the rear windows.

Or would l stand a better chance with a Defender 110 "Commercial" with the five seats and no rear windows.

l don't really want the two seat "van" version as l used the rear footwell on my old 110 SW to transport large screen TV sets.

You can run a utility xs as a commercial. A station wagon is classed as a car for hmrc purposes.

I’d imagine if you had a 5 seat Utility Station Wagon with an N1 Log book - there should be no issues? That’s the same as a DCPU. 2008 2.4 110 Utility Station Wagon XS.

It's a bit of a minefield.

l think if it's a Station Wagon l would just have to keep
it as a private vehicle and charge the business for mileage.

The 110 Utility Station Wagon, l am not so sure how it's seen by HMRC. The only lneos Grenadier classed as "Commercial" is the two seat version.

All 2015 Station Wagons, even my 7 seater, are recorded as a Double Cab (DC) on the log book.
I've no idea how HMRC or anyone else would know if it was a DCPU, USW or SW without actually inspecting it.

l didn't know that! lt's so complicated

So the law just changed on this. lf you buy a new "Double Cab" it's now classified as a car with HMRC.

l assume this also applies to used vehicles, so l've just missed the boat and if l buy a 2015 Defender that's classed as a Double Cab l can no longer put it through the business as a Commercial Vehicle?

I would check with your accountant but I know previously only a 90 H/T or 110 Utility, DCPU, etc were acceptable by HMRC
SW in either 90 or 110 form was a CAR……

Yes the 110 Utility was always the one argued about. I guess it will depend on what the V5 classification is.
lf as suggested above it's D/C then l guess you could put it though, although the law changed again in April 2015 so it may be too late for that as well now.

It doesn't apply retrospectively if you currently run a double cab as a 'van' until 2029 (or until you sell it).
It applies to all new double cabs from Apr 5th this year.

HMRC does not care what DVLA think ….. two totally different systems
110 Utility was always HMRC compliant

my understanding is all post 2010 are commercial vehicles.
I had VAT / HMRC 'investigate' my purchase when I claimed the VAT back and once provided the relevant docs no further questions were asked.
to my mind that confirms what I understood to be the case ie 110 station wagon is indeed a commercial vehicle as the road tax suggests. no different I guess to a multi seat transit van ?

But is it still compliant after the new law on double cabs? Obviously if you've already got one that's okay but what if you buy one now?

instead of asking on here why not clarify specifically with your Accountant as what we all believe and what may now apply might not be the full story..........

"my" understanding is as per @camelman above and that it does not apply retrospectively, only to newly registered vehicles ??

By jove you're correct, l've looked at the three 110's on sale at my local dealer. All 110 XS Station Wagons, 2012, 2013, and 2015

The V5's all say "D/C"

That's where it always falls down, the vehicle is classed as D/C on the V5 but my Accountant thinks HMRC will still see it as a car.

But others say no they won't.

And nobody seems to know if the cutoff for buying a double cab also applies to second hand vehicles such as old Defenders.
