The law is very clear

IF the incident happened as reported the old boy will be fine.

That is a very good link ZED.

Especially the section on Use of Force against those committing crime.

Now I have very little sympathy for those who get hurt or killed whilst knowingly committing a crime, especially when violence or the threat of violence occurs so the victim is in danger of being hurt or killed.

Having said that I would want the police to carry out their duties properly. Otherwise there is the possibility of murders being carried out under the disguise of self defence. I am not suggesting this is the case this time.

Please let the police do their job and IF the facts are as clear as might be suggested by the news report the 78 year old will be released without charge. Otherwise it is down to the jury of 12.

Was it self defence? I do not know. One less scum out of the way? Extremely possible.

Just remember farmer Tony Martin. Not self defence firing 3 Times into back of retreating criminals with an illegal weapon?

Let the police do their job and hopefully that 78 year old gentleman is not charged.

Heard he was first arrested for a lesser offence, ABH? but then further arrested for murder.

Now correct me if I am wrong but isn't the criteria for murder that the action of killing the victim was premeditated & intentional? In which case he must have invited the burglars there with the express intention of killing one or both of them!

OK so we don't know all the facts but on the face of it an old man has been held hostage by an intruder less than half his age & after a struggle has stabbed him in self defence.

If this was a genuine burglar who was stabbed in self defence then give the old boy a medal Thumbs Up

Agree 100%

Here, thank God if you stab him on your property and you are grey haired like myself you DO get away with it.
You only have to make it sufficiently credible that you felt threatened.. like me as a woman living alone that is fine.
I only have to make sure to kill him with a machete or bread knife, a normal household item, not a weapon.

I have a great big machete next to my bed at all times and that is perfectly legal. My grandpa use to put his teeth next his bed with a big knife between them to scare of scumbags Fixing Land Rovers in rural Guanacaste

In these cases the police should ”presume innocense” even more than in regular cases. Allthough i understand that this needs to be investigated

I hope someone is looking after the old boy's mental welfare.

What he went through would have been traumatic and will probably affect the years he has left.

AMBxx, a machete is a normal everyday household item in many parts of the world.

Since Annette is in Costa Rica then it would be a very useful everyday tool.

To clearify on my first post. All under the assumption that it went as described in the newspaper.

In these cases where people have endured a very traumatic experience, violence and taking an other mans life, I had hoped he would be first treated as a victim. And give HIM assistance in dealing with this terrible situation. Instead aggrevating the situation by arresting him and put HIM in jail.

The main reason for me is that the police can/should presume that he hasn’t committed a crime because he acted in self defense and therefore the interest of the victim should be the first priority. a defender from 1984 pretending to be a puma with a touch of Range Rover

TDi4, the elderly gentleman was not put in jail, yes he may well been kept overnight in police custody.

From . BBC news just now

Quote:

A 78-year-old man arrested on suspicion of murder after a suspected burglar was stabbed to death has been bailed.

The man, named locally as Richard Osborn-Brooks, found two intruders in South Park Crescent, Hither Green, south-east London, early on Wednesday.

A 37-year-old man, armed with a screwdriver, forced the homeowner into his kitchen where a struggle ensued and the suspect was stabbed, the Met said.

Mr Osborn-Brooks has been bailed until May pending further enquiries.

The police do have to investigate the death of the 37 year old intruder. Hopefully the 'facts' are as have been reported so far and hopefully no charges will be brought against Mr Osborn-Brooks.

However the police have to do their work . Hopefully the Coroners Court will put the death of the intruder down as something like 'accidental death/lawful killing' etc so no charges will be brought against Mr Osborn-Brooks

What we do not know is the actual cause of death at this moment in time. Was it a single stab wound to the front of the intruder or was it say multiple stab wounds to the back of the intruder?

The man should be elevated to the House of Lords as he has done more for the public good than most of the self serving politicians who are sent there. Such a shame he did not manage to get the other one, he could have had the George Medal as well.

The intruder killed during a raid on a pensioner's home was wanted over a separate burglary involving another elderly victim, it has emerged.
Henry Vincent, 37, from Kent, was stabbed during a break-in at the home of pensioner, Richard Osborn-Brooks, 78, in Hither Green on Wednesday.
In January, he was named and pictured by Kent Police investigating a distraction burglary when jewellery and valuables were stolen from a man in his 70s
