Do you mean before or after the work is completed?
I would expect that if it's before then the PD rights would only apply if the newly carved off plot was eligible in its own right? Afterwards, it would seem logical that they can't realistically ask for the work to be undone. Of course all of the above assumes there is some logic to planning! |

Its not that simple, It depends upon what the Conditions say on the Decision Notice, and what was applied for in the first place. Safest bet ask your planning department.

You can get a letter from your planning department which effectively confirms whether your interpretation of the PD laws are correct. I am building a large outbuilding (80 m2) under PD - I considered that £40 for official confirmation of my reading of the regs was reasonable compared to a £20k build cost.
I would feel inclined to build under PD before sale of the land - then sell the land with the new building on it. The council might be less inclined to agree with PD if the proposed building isn't ancillary to a dwelling on the same bit of land. No professional qualifications - just read up lots on the subject.
